Terms & Conditions

The agreement between you and Zenvia Health Private Limited for your use of the Sugar360 app.

Effective 16 Sep 2026

These terms govern your use of Sugar360, a diabetes care-management service provided by Zenvia Health Private Limited, Jeewanjyotee Medicare, 408 Hill Cart Road, Sevoke More, Siliguri, Darjeeling, West Bengal 734001, India ("we", "us", "our").

By creating an account, or by using an account created for you by your care centre, you agree to these terms. If you do not agree, do not use the service.

What Sugar360 is

Sugar360 is a tool for recording diabetes information and coordinating care between you, your caregiver and your clinical care team. It provides the software; it does not provide medical treatment.

Clinical care is provided by your care centre and the clinicians who work there. We are not your doctor, we do not employ your clinicians, and we do not supervise their advice. Any treatment relationship is between you and your centre.

Sugar360 is not a medical device and must not be used as one.

Who may use it

  • You must be 18 or older to hold an account in your own name.
  • A parent or legal guardian may hold and manage an account on behalf of a patient under 18.
  • A caregiver may be linked to a patient's account only with that patient's consent, which the patient can withdraw at any time.
  • Clinical accounts are issued by a care centre to its own staff, and only for their work at that centre.

Your account

  • Give accurate information, and keep it current. Clinical decisions may be made using what you enter.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • If your account was created at a care centre, change the temporary password when you first sign in.
  • Tell us at once if you believe someone else has access to your account.
  • One account per person. Do not share an account, and do not use anybody else's.

What you must not do

  • Use Sugar360 for anything unlawful, or to harm or harass another person
  • Attempt to reach records belonging to a patient you are not authorised to see
  • Probe, scan, or attempt to breach the security of the service, or work around any access control
  • Copy, scrape or extract data in bulk, whether by hand or by automated means
  • Reverse engineer, decompile or attempt to derive the source code of the app, except where law permits it despite this restriction
  • Upload anything containing malware, or any content you have no right to share
  • Impersonate a clinician, or present yourself as authorised by a care centre when you are not
  • Resell, sublicense or make the service available to anyone outside your own use of it

Your content

What you record — readings, meals, photographs, notes and uploaded documents — remains yours. You grant us the licence needed to host it, display it to the people you have authorised, process it to provide the features you use, and back it up. That licence exists only to run the service.

Do not upload anything you have no right to upload, and do not upload another person's health information unless you are their caregiver or clinician and are permitted to do so.

Clinical records are held by your centre

Consultation notes, prescriptions, diagnoses and other records created by your care team are the clinical records of your care centre. Your centre is required by law to retain them, and closing your Sugar360 account does not delete them. What closure does remove is described in the Privacy Policy.

AI-assisted features

Sugar360 includes two features that use automated analysis: nutrition estimates from meal photographs or descriptions, and an in-app assistant that answers general questions.

These are provided for information only. They can be inaccurate. They are not medical advice, are not reviewed by a clinician before you see them, and must not be used to decide anything about your treatment. Check and correct any estimate before saving it.

You may decline AI analysis when you join, and withdraw that permission at any time under Menu, Additional Settings, Permissions.

Connected devices and health platforms

Sugar360 can receive readings from a connected glucose device and from Health Connect or Apple Health. Those services are operated by other companies under their own terms. We reproduce what they report and do not verify its accuracy, and we are not responsible for their availability or for the correctness of their data.

Notifications

Reminders, appointment notices and alerts are a convenience, not a guarantee. Delivery depends on your device, your network and your notification settings, any of which can prevent a message arriving. You remain responsible for taking your medicines and attending your appointments.

Availability

We aim to keep Sugar360 available, but we do not promise uninterrupted service. It may be unavailable for maintenance, for reasons outside our control, or because a third-party provider has failed. Features may change, and may be added or withdrawn.

Where a change materially reduces what the service does, we will give notice in the app before it takes effect.

Fees

Where Sugar360 is provided as part of a care programme purchased from a centre, the fees, duration and refund terms of that programme are agreed with your centre and are not governed by these terms.

Suspension and closure

You may close your account at any time from within the app, or by writing to us. Closure is permanent and cannot be reversed.

We may suspend or close an account that breaches these terms, that is being used to reach another person's records, or where we are required to by law. Where it is lawful and practical to do so, we will tell you why.

Our responsibility to you

Sugar360 is provided as it is. To the extent Indian law allows, we do not give warranties that the service will be uninterrupted, error-free, or fit for any particular purpose, and we are not liable for:

  • Clinical decisions taken by you, your caregiver or your care team
  • The accuracy of information entered by any user, or reported by a connected device or health platform
  • Loss arising from a notification that did not arrive
  • Indirect or consequential loss, or loss of profit or data

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Indian law.

Indemnity

If a claim is brought against us because you used Sugar360 unlawfully, breached these terms, or infringed somebody's rights, you agree to cover the reasonable losses we incur as a result.

Intellectual property

Sugar360, its software, design, and content other than yours belong to us or our licensors. You are given a personal, non-exclusive, non-transferable licence to use the app for your own care or, for a clinician, for your work at your centre. Nothing else is granted.

Privacy

How we handle your information is set out in the Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms. If a change materially affects your rights, we will notify you in the app before it takes effect. Continuing to use Sugar360 afterwards means you accept the updated terms. The date this version took effect is shown at the top of this page.

Governing law

These terms are governed by the laws of India. The courts Siliguri have exclusive jurisdiction, except that either of us may seek urgent relief in any court with proper jurisdiction.

General

  • If any part of these terms is unenforceable, the rest continues to apply.
  • If we do not enforce a term immediately, we do not give up the right to do so later.
  • You may not transfer your rights under these terms. We may transfer ours as part of a reorganisation or sale of the business, on notice to you.
  • These terms, with the Privacy Policy and the Medical Disclaimer, are the whole agreement between us about Sugar360.
